Motorcycle Rental Terms and Conditions – Motorland.rent
§1 General Provisions
These Terms and Conditions define the rules for renting motorcycles offered under the Motorland.rent brand.
The owner of the brand and the entity providing the rental service is Euro-Trans Maciej Cieślak, Tax ID (NIP): 8351540507, with its registered office at Armii Krajowej 3, 96-200 Rawa Mazowiecka, Poland.
The Renter is obliged to read these Terms and Conditions before concluding the motorcycle rental agreement.
These Terms and Conditions constitute an integral part of the motorcycle rental agreement.
§2 Motorcycle Rental Conditions
The motorcycle may be rented by a natural person who has held a valid Category A driving licence for at least 4 years.
The Renter must present a valid identity document and a driving licence authorizing them to operate a motorcycle.
The minimum rental period for a motorcycle is 3 days.
The motorcycle may only be used by the person indicated in the rental agreement unless the Lessor agrees to an additional rider.
§3 Deposit and Liability
A deposit of 500 EUR is required when the motorcycle is handed over.
The deposit also constitutes the maximum financial liability of the Renter in the event of damage occurring during the rental period.
If no damage occurs and all contractual obligations are fulfilled, the deposit will be refunded after the end of the rental period.
§4 Insurance
All motorcycles are covered by mandatory motor vehicle liability insurance.
The Renter’s deductible in the event of damage is 500 EUR, which is equal to the amount of the deposit.
The Renter is obliged to immediately inform the Lessor of any collision, accident, or damage to the motorcycle.
§5 Rules for Using the Motorcycle
The Renter undertakes to use the motorcycle in accordance with its intended purpose and applicable laws.
The following is prohibited:
- operating the motorcycle under the influence of alcohol or narcotic substances,
- using the motorcycle in races or on racing tracks,
- allowing third parties to use the motorcycle without the Lessor’s consent.
The Renter is obliged to properly secure the motorcycle against theft.
§6 Fuel
The motorcycle is handed over with a specified fuel level indicated in the handover protocol.
The Renter is obliged to return the motorcycle with the same fuel level as when it was received.
If the motorcycle is returned with a lower fuel level, the Lessor may charge the Renter for the cost of refueling.
§7 International Travel
The motorcycle may be used to travel outside the country where the rental takes place.
Travel to Morocco is possible after prior agreement with the Lessor.
In the case of travel to Morocco, an additional administrative fee of 10 EUR per rental day will be charged.
The Renter will receive a special authorization to cross the continental border, required when entering Morocco.
Motorcycle rental is provided without mileage limits.
§8 Motorcycle Breakdown
In the event of a motorcycle breakdown during the rental period, the Lessor undertakes to provide another available motorcycle.
If the replacement motorcycle is:
- more expensive – the Renter pays the price difference according to the rental price of that model,
- cheaper – the Lessor refunds the Renter the appropriate portion of the fee for unused days based on the rental price of that model.
§9 Early Termination of Rental
If the rental is terminated earlier for any reason, the Renter is entitled to a refund only for the unused rental days.
The refund is calculated proportionally according to the rental price specified in the agreement.
§10 Return of the Motorcycle
The Renter is obliged to return the motorcycle in no worse condition, taking into account normal wear resulting from proper use.
The return of the motorcycle takes place on the basis of a handover protocol.
§11 Final Provisions
In matters not regulated by these Terms and Conditions, the provisions of European Union law shall apply.
Any disputes arising from the rental agreement shall be settled by the court competent for the registered office of the Lessor.
These Terms and Conditions enter into force on the date of their publication.
